Procedure:
The hearing of this matter was arranged to take place on Thursday 22nd February 2018 at 10.30am in the offices of the Workplace Relations Commission (WRC), Dublin 4. The Respondent attended as scheduled, The Complainant did not attend the hearing. Correspondence outlining arrangements for the hearing was issued to the parties some four weeks in advance of the hearing. Efforts were made to contact the complainant, all such efforts were unsuccessful.
In accordance with Section 39 of the Redundancy Payments Acts 1967 - 2014 and/or Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaint(s) to me by the Director General, I inquired into the complaint(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s).

Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
As the Complainant did not attend the hearing of the complaints and as no contact was made with the WRC the complaint fails for lack of prosecution. |
