Procedure:
In accordance withSection 13 of the Industrial Relations Acts 1969following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The Complainant commenced employment with the Respondent on 8 October 2011, as a helicopter pilot. The Complainant was still employed there at the time the complaint was lodged. |
Summary of Complainant’s Case:
The Complainant did not attend for the Hearing despite having been appropriately notified. However, in his complaint form, the Complainant stated that he had been refused two by half day overtime claims. According to the Complainant, he was entitled to have these claims paid in line with a collective Labour Agreement that was in existence at the time. |
Summary of Respondent’s Case:
Despite being appropriately notified of the Hearing, the Respondent did not respond on the day. |
Findings and Conclusions:
Despite having been properly notified of the Hearing, neither the Complainant nor the Respondent attended on the day. |
Decision:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.]
Based on the non attendance of the Complainant, The case falls due to lack of prosecution. |
