Procedure:
In accordance with Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
On 29 June 2016, the complainant made a complaint to the Workplace Relations Commission pursuant to the Unfair Dismissal Act, 1977. The complaint was scheduled for adjudication on 10 November 2017. Both parties were in attendance however, the case was adjourned. The case was rescheduled for 5 April 2018. At the time the adjudication was scheduled to commence, it became apparent that there was no appearance by or on behalf of the complainant or the respondent. I verified that the parties were on notice of the adjudication and after waiting some time to accommodate a late arrival, I proceeded with the adjudication. In accordance with Section 41(4) of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint. |

Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
The complaint made pursuant to the Unfair Dismissal Act is not well founded as the complainant failed to attend the hearing to prosecute this claim. |
