Complaint seeking adjudication by the Workplace Relations Commission under Section 39 of the Redundancy Payments Act, 1967 | CA-00014534-001 | 27/09/2017 |
Date of Adjudication Hearing: 22/01/2018
Workplace Relations Commission Adjudication Officer: Ewa Sobanska
Procedure:
In accordance with Section 39 of the Redundancy Payments Acts 1967 - 2014 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant submits in the WRC Complaint Form that he was on sick leave when the Respondent closed down. He has not received any communication from the Respondent in that regard. He claims that he did not receive his redundancy entitlements. |
Summary of Complainant’s Case:
There was no appearance by or on behalf of the Complainant. |
Summary of Respondent’s Case:
There was no appearance by or on behalf of the Respondent. |
Findings and Conclusions:
As the Complainant did not attend the adjudication hearing to advance his complaint, I do not make any findings or conclusions. |
Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2014 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
As the Complainant did not attend to advance his complaint, I deem that the complaint made pursuant to the Redundancy Payments Act is not well-founded. |
