Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 79 of the Employment Equality Acts, 1998 - 2015, following the referral of the complaint(s) to me by the Director General, I inquired into the complaint(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s).
The hearing of this matter was arranged to take place on Tuesday 10th April 2018 at 09.00am in the offices of the Workplace Relations Commission, Lansdowne House, Lansdowne Road, Dublin 4. The Respondent’s representatives attended as scheduled. The complainant did not attend the hearing.
Correspondence dated 14th March 2018 was issued to the Complainant outlining the arrangements for the hearing.
On the 05/04/2018 an exchange of emails between the Complainant and WRC commenced. Basically the Complainant informed the WRC that she had to work and sent a copy of her work roster, she also raised some questions regarding the need for witnesses to attend. On 09/04/2018 the WRC informed the Complainant that her request for a postponement of the hearing scheduled for 10/04/2018 had been refused.
The Respondent’s HR Manager who was in attendance for the hearing informed the Adjudication Officer that the Complainant had not asked for time off work to attend the hearing.

Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
As the Complainant did not attend the hearing of the complaint it is dismissed for lack of prosecution. The Complaint fails. |
