Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 [and/or Section 39 of the Redundancy Payments Acts 1967 - 2014] following the referral of the complaint/dispute to me by the Director General, I inquired into the complaint/dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint/dispute.
Summary of Complainant’s Case:
The claimant was employed as a factory manager with the respondent from 6th.April 1997 to the 26th.Oct. 2016.He submitted the respondent was in breach of the Act for failing to pay him his statutory redundancy. The factory closed overnight without notice and the claimant outlined his efforts to engage with the respondent to secure his statutory entitlements but to no avail .No response was forthcoming from the respondent. |

Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint/dispute in accordance with the relevant redress provisions under Schedule 6 of that Act.
[Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
On the basis of the uncontested evidence of the claimant, I find the complaint to be well founded and I require the respondent to pay the claimant his statutory entitlement within 42 days of the date of this decision. |
