Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and the abovementioned Act,
following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The respondent employed the complainant as a graphic designer in the period from 4th of October 1999 until the 17th of November 2017. He was paid €528.52 gross per week. The parties were notified of the time, date and venue set for the hearing. |
Summary of Complainant’s Case:
The complainant submits that the business was closed without notice on the 17th of November 2017 and that he did not receive his entitlement to statutory minimum notice (8 weeks) in the amount of €4,228.16. Furthermore, he was not paid wages due and owing in the amount of €630 net. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Based on the uncontested evidence adduced at hearing I find that the complaint is well founded. I hereby require that the respondent pay the complainant €4,858.16 (say four thousand eight hundred and fifty eight euro and 16 cent) net for breach of the Act. |
