In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:
This complaint refers to the alleged breach of annual leave entitlements under the Organisation of Working Time Act, 1997.
Summary of Complainant’s Case:
The Complainant, a Polish National, submitted he did not receive his annual leave entitlements for 2017.
Summary of Respondent’s Case:
The Respondent made a written submission on 25th September 2018 advising the Complainant would be provided with his entitlements and that the Respondent would not be attending the hearing.
Findings and Conclusions:
Neither the Complainant nor Respondent attended the hearing. I am satisfied the parties were properly notified of the hearing date and location.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint.
As the parties did not attend the hearing I decide that the complaint is not upheld due to lack of prosecution.
