Procedure:
In accordance with Section 13 of the Industrial Relations Acts 1969] following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Summary of Complainant’s Case:
The claimant commenced employment with the respondent in 2004 as a Caretaker and was assimilated onto 95% of the Craftsman’s rate of pay in 2007 in recognition of his increased workload and responsibilities.It was submitted that the claimant’s workload had increased considerably since that time and he sought to have his pay increased in recognition of the additional responsibilities attaching to his job in 2017.It was submitted that the claimant should have parity of pay with that of Head Groundsman and should be assimilated on to the max of that scale given his 14 years service with the respondent. The union set out a chronology of the additional responsibilities - in terms of premises and staff - taken on by the claimant over the years and submitted that the claimant’s current duties require specialised training – enabling him to register for fire prevention and health & safety.It was submitted that the respondent had never contested the extent of the work , commitment or skill that the claimant provided. |
Summary of Respondent’s Case:
The respondent did not contest the submissions made by the union and accepted that the claimant was doing a high value job that warranted parity with Head Groundsman. |
Recommendation:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.]
In light of the fact that there is no dispute between the parties on the substantive matter of the claimant’s grading, I recommend that he be assimilated on to the maximum point of the Head Groundsman scale with effect from the 1st.October 2017 |
