Procedure:

In accordance with Section 39 of the Redundancy Payments Acts 1967 - 2014andfollowing the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

BACKGROUND.

The Complainant was employed with the Respondent Company from 21st April 2015 until the Employment was terminated by reason of redundancy on 21st December 2017. The Complainant was paid £750.00 gross per week and he worked 40 hours a week. The Complainant referred a complaint to the Workplace Relations Commission on 17th May 2018 alleging he had not been paid his redundancy entitlements.

SUMMARY OF COMPLAINANT’S POSITION.

The Complainant stated that his employment with the Respondent was terminated by reason of his redundancy on 21st December 2017. He stated he had not been paid his redundancy entitlements. He referred a complaint to the WRC on 17th May 2018.

DECISION.

Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act. In accordance with Section 39 of the Act I declare this complaint is well founded.

The Complainant commenced his employment on 21st April 2015.

His employment was terminated by reason of redundancy on 21st December 2017.

The Complainant was paid £750.00 gross per week.

There were no periods of non-reckonable service.

I direct the Respondent to pay the Complainant his Redundancy entitlements in accordance with the Act, within 42 days of the date of this Decision
