Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 and/or Section 39 of the Redundancy Payments Acts 1967 - 2014 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

The Complainant was employed by the Respondent from 01/03/2005 until 08/06/2015 – his job was that of supervisor.

The Complainant was made redundant from his position due to insolvency in the Respondent company.

Summary of Complainant’s Case:

The Complainant was made redundant due to the insolvency of the Respondent company who did not have the funds to pay him his statutory redundancy payment.

Summary of Respondent’s Case:

The Respondent did not dispute the summary provided by the Complainant.

Findings and Conclusions:

The Complainant was employed from the 01/03/2005 until his redundancy on 08/06/2018.

Under Redundancy legislation he is due a statutory lump sum of €16,411.43.

I hereby order the Respondent to make this payment to the Complainant within 42 days of the date of this Decision.

Decision:

Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
