Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 8 of the Unfair Dismissals Acts, 1977 - 2015, Section 27 of the Organisation of Working Time Act 1997 (x3) and Section 13 of the Industrial Relations Acts 1969 and The Payment of Wages Act, 1991, following the referral of the complaint(s)/dispute(s) to me by the Director General, I chaired a hearing to inquire into the complaint(s)/dispute(s) and to give the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The Complainant claims in the Complaint document that he was employed by the Respondent for one month from the 8th March 2017 to the 3rd April 2017 and sought adjudication on the above complaints from the WRC. The Hearing was arranged for 4th April 2018. The Claimant or his representative did not appear. |
Summary of Complainant’s Case:
As the Complainant did not appear I did not receive evidence of his complaints. |
Summary of Respondent’s Case:
The Respondent did appear, but in the circumstances of the Complainants non-appearance I took no evidence. |
Findings and Conclusions:
I find that the Complainants claims fail for want of prosecution. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.

I find that the claims fail for want of prosecution. |
