Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

Findings and Conclusions:
Subsequent to the complainant making his complaint the respondent wrote indicating that the name of the company used was incorrect. The complainant then made the same complaint within the statutory time limits against the correct respondent and the hearing took place. In the circumstances I conclude that I do not have jurisdiction to hear the complaint against this respondent. |
Decision:
Section 6 of the Payment of Wages Act, 1991 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 6 of that Act. I find that the complaint is not well founded.
Section 11 of the Minimum Notice & Terms of Employment Act, 1973 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
Section 27 of the Organisation of Working Time Act, 1997 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under that Act.
Section 7 of the Terms of Employment (Information) Act, 1994 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act
I do not have jurisdiction to hear the complaints against this respondent. |
