Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

Summary of Complainant’s Case:

The Complainant started work on 6 November 2017 and his employment ended on 5 January 2018.

At the end of his employment the Complainant asked the Respondent about monies that were due to him in relation to 3 bank holidays, annual leave entitlement and 2 days wages for work done fo which he had not been paid.

The Respondent told him to send him the dates that he was owed. He did so and the Respondent told him that he was owed €729.00, which the Complainant accepted was correct. However the Respondent did not pay him and after further request on12 February 2018 he told the Complainant that he had transferred the money into the Complainant’s account, which he had not.

The Respondent at no stage denied that the money was owing to the Complainant but he still did not pay it.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.

Based on the uncontested evidence of the Complainant and having satisfied that the Respondent was on notice of the adjudication hearing, I find that this complaint to be well founded and I make the award of €729.00 to be paid by the Respondent to the Complainant.
