Procedure:
In accordance with Section 13 of the Industrial Relations Acts 1969, this complaint was assigned to me by the Director General. A hearing was arranged for October 8th 2018; however, the complainant did not attend, although she was properly on notice of the time and date of the hearing. The Managing Director attended for the respondent.
Background:
In her complaint form, the complainant said that on Friday, May 11th 2018, she was on her way to work when she was knocked down and suffered an injury. Her attendance was irregular from then on and she has been absent continuously from June 13th. Her complaint is that she is seeking a letter from her employer confirming that she had an accident on her way to work, that she is not being paid while she is out sick and that her last day at work was June 13th 2018. |
Summary of Complainant’s Case:
The complainant did not attend the hearing. |
Summary of Respondent’s Case:
The managing director who attended the hearing said that on July 5th 2018, he sent a letter to the respondent with the information she requested. When he received details about the complainant’s complaint to the WRC, he noticed that the address on the complaint form is different to the address on file in the company. He said he was not notified of a change of the complainant’s address. |
Findings and Conclusions:
This complaint is about a request for a letter for the Department of Social Protection. The letter was sent to the complainant at her last known address. It is not a dispute under the Industrial Relations Act and is not an appropriate matter for adjudication. |
Decision:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
As the complainant did not attend to elucidate on the issue about which she claimed to be in dispute with her employer, I make no recommendation. |
