In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 8 of the Unfair Dismissals Acts, 1977 - 2015,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The Complainant emailed the Workplace Relations Commission on the 3rd April 2018, the day prior to the scheduled hearing, seeking a postponement on health grounds. The Complainant was asked to resubmit the request with suitable supporting documentation for the reason for the requested postponement. No supporting documentation was provided. Taking the above factors into account my decision is that the complaint fails for lack of prosecution. |
