Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant was dismissed from the Respondent’s company on foot of a significant number of complaints concerning his bullying of many of the employees with whom he was a team leader. This was contained in the list of documents submitted pre-hearing. |
Summary of Complainant’s Case:
The Complainant did not appear on the day of the hearing. He had previously failed to appear at a hearing set up to hear his case. |
Summary of Respondent’s Case:
There was no oral evidence that the Respondent could respond to, though they did hand in a submission to me. |
Findings and Conclusions:
As the Complainant did not appear and present his case to the Tribunal in oral submission, I find that I was not able to proceed with the case. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
I find that the complaint fails for want of prosecution. |
