Procedure:
In accordance with Section 39 of the Redundancy Payments Acts 1967 - following the referral of the complaints to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints
Background:
The claimant was employed as a Manager by the respondent (now in liquation) from the 1st July 1988 to the end of April 2017. He was paid €940.00 gross (€766 net per week). On the 18th November 2016 he was placed on lay off and at the beginning of March 2017 he was informed that he was being put on notice with his employment would be terminated at the end of April 2017.
Findings:
The complaint was received by the service on the 24th January 2018.
I find that the liquidator’s representative did not dispute the facts of the complaint.
Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
I find the complaint is well founded and I award him his redundancy based on his reckonable service with the respondent from the 1st July 1988 to the 30th April 2017.
