Procedure:
In accordance with Section 25 of the Equal Status Act, 2000, and following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
This matter was due to be heard on Tuesday 14th August 2018 at 12:00. The complainant did not attend the hearing. I established that the complainant was on notice of the date and time of the hearing of his complaint. I also waited for approximately 20 minutes in the event that the complainant had been delayed. There was no further contact from the complainant. |

The complainant did not attend the hearing. |
Summary of Respondent’s Case:
The respondent attended the hearing together with legal representation. |
Findings and Conclusions:
On the basis that the complainant did not attend the hearing, I was unable to proceed with the hearing as the burden is on the complainant to establish a prima facie case. |
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
The complainant failed to establish a prima facie case of discriminatory treatment, therefore the case fails. |
