Procedure:

In accordance with Section 25 of the Equal Status Act, 2000, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

The Complainant alleged that he was discriminated against by the Respondent in relation to the provision of goods, services or facilities. Reasons were Gender and Race.

Summary of Complainant’s Case:

The Complainant failed to attend the hearing and no communication was received by the Workplace Relations Commission (WRC) in relation to his non-attendance.

Correspondence in relation to the hearing was sent to the Complainant some four weeks previous to the date of hearing.

Summary of Respondent’s Case:

With the Complainant failing to attend the scheduled hearing there was no complaint to be answered.

Findings and Conclusions:

Doe to the Complainant’s failure to attend the scheduled hearing the complaint fails for lack of prosecution.

Decision:

Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.

Complaint fails for lack of prosecution.
