Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

Summary of Complainant’s Case:
The Complainant is employed as a Bus Driver since April 1st 2007. His complaint is that his employer failed to pay sick pay properly due to him. He requested holiday leave as per custom and practice by written application in February 2018 and was approved for 5 days holiday for the period of August 5th 2018.The Thursday before the holiday was due the Complainat became ill. However, knowing his holiday were due he continued on. On the Friday he received a call from the holiday rostering Inspector, informing him his holiday application was denied. When the Complainant questioned this, he was told talk to the Local Services Manager. The Complainants local Union Representative approached the Services Manager and was told he was too busy to talk to him. Phone calls from the Union Representative were not taken or returned by the Services Manager. The Complainants illness became worse and after visiting the Company Doctor he was excused from work for 7 days. When the Complainant returned to work her was not paid his sick pay properly due to him. When the non payment was questioned the Union Representative was told that an Investigation was under way and if he didn’t like that to take the claim to the WRC. Attempts to resolve the matter locally were rebuffed. The Complainant is due 627.43 Euros. The Service Manager has since left the Company and the issue remains unresolved. |
Summary of Respondent’s Case:
A Complaint was received by the Director General of the Workplace Relations Commission by the Complainant on January 8th 2019 2019 alleging that his employer contravened the provisions of the Payment of Wages Act 1977 in relation to him. The said complaint was referred to me for investigation. A Hearing for that purpose was held on November 5th 2019. There was no appearance by or on behalf of the Respondent at the Hearing. I am satisfied that the said Respondent was informed in writing of the date, time and place at which the Hearing to investigate the complaint would be held and were not present at the Hearing. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 5 of the Payment of Wages Act 1991 states the following:
Legitimate deductions from wages of employees are defined in Section 5 of the Payment of Wages Act 1991 above. Based on the uncontested evidence of the Complainant, the deduction of 627.43 Euros did not fulfil any of these legitimate criteria for a deduction and he was not paid wages that were properly due to him of 627.43 Euros. I award the Complainant 627.43 Euros. |
