Date of Adjudication Hearing: 05/02/2019
Workplace Relations Commission Adjudication Officer: Peter O'Brien
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 8 of the Unfair Dismissals Acts, 1977 – 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The Complainant was alleging unfair dismissal. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
A Complaint was received by the Director General of the Workplace Relations Commission on August 18th 2018 by the Complainant alleging that her employer contravened the provisions of the Unfair Dismissals Act 1977 in relation to her. The said complaint was referred to me for investigation. A Hearing for that purpose was held on February 5th 2019. The WRC was notified by the Complainants Solicitor that they or the Complainant would not be attending the Hearing. In these circumstances and in the absence of any evidence to the contrary having been adduced before me, I must conclude that the within complaint is not well founded and I decide accordingly. |
