Procedure:
In accordance with Section 13 of the Industrial Relations Acts 1969, this dispute was assigned to me by the Director General. A hearing was arranged for October 22nd 2018; however the parties did not attend. The solicitor for the complainant attended and advised me that discussions were taking place between the complainant and her employer and he anticipated that the matters would be resolved. He said that he would confirm this in early January.
On March 7th, the complainant solicitors wrote to me to request a further adjournment until March 31st 2019. I responded that, in the absence of any further contact, or confirmation from the complainant that the dispute has been settled, a decision would be issued at the end of March.
Decision:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
In the circumstances where the complainant did not attend the hearing, and in the absence of any evidence to the contrary having been submitted, I must conclude that she has decided not to progress the resolution of her dispute at a hearing under the Industrial Relations Acts. On this basis, I make no recommendation in respect of this matter. |
