Complaint seeking adjudication by the Workplace Relations Commission under section 77 of the Employment Equality Act, 1998 | CA-00022308-001 | 02/10/2018 |
Date of Adjudication Hearing: 06/03/2019
Workplace Relations Commission Adjudication Officer: Niamh O'Carroll Kelly
Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
No appearance for or on behalf of the complainant. |
Summary of Respondent’s Case:
The respondent appeared and informed me that the matter had been resolved between the parties. |
Findings and Conclusions:
The complainant e-mailed the WRC prior to the hearing to state that the matter had been resolved with the respondent. The respondent confirmed that at the hearing. The complainant however did not withdraw the claim. Therefore, I am obliged to issue a decision. On the basis that no evidence was adduced, I can only find that the complaint is not well founded and accordingly fails. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
The complaint fails. |
