Procedure:
At the time the adjudication was scheduled to commence, it was apparent that there was no attendance by or on behalf of the complainant. The respondent was in attendance. I verified that the complainant was on notice of the time, date and venue of the adjudication. I checked that the correspondence was issued to the most recent address provided by the complainant. Having taken these steps, I proceeded with the adjudication in the absence of the complainant.
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Summary of Complainant’s Case:
The complainant did not attend to give evidence to support any contravention of the statutes cited in the complaint form. |
Summary of Respondent’s Case:
The respondent was in attendance to answer the complaints. |
Findings and Conclusions:
In respect of each complaint submitted pursuant to the Workplace Relations Act, the Organisation of Working Time Act and the Payment of Wages Act, I find that each complaint is not well founded as there is no evidence of any contravention. |
Decisions:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
