Procedure:
This dispute was submitted to the WRC on January 24th 2019 and in accordance with Section 13 of the Industrial Relations Acts 1969, it was assigned to me by the Director General. A hearing was arranged for April 3rd 2019, for the parties to have an opportunity to be heard and to set out their positions with regard to the matter in dispute. The complainant did not attend the hearing, although I am satisfied that she was properly notified of the date and time at which it was to take place. The Managing Director of the respondent company attended, accompanied by an office manager.
Decision:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
In the circumstances where the complainant did not attend the hearing, and in the absence of any evidence to the contrary having been adduced before me, I must conclude that the complainant has decided not to proceed with a resolution of this dispute with her former employer. I therefore recommend that no action be taken by the respondent and I further recommend that the matter is considered to be closed. |
