Complaint seeking adjudication by the Workplace Relations Commission under Section 39 of the Redundancy Payments Act, 1967 | CA-00026219-001 | 11/02/2019 |
Date of Adjudication Hearing: 05/04/2019
Workplace Relations Commission Adjudication Officer: Catherine Byrne
Procedure:
This complaint was submitted to the WRC on February 11th 2019 and, in accordance with Section 39 of the Redundancy Payments Acts 1967 – 2014, it was assigned to me by the Director General. A hearing was arranged for April 5th 2019 for the parties to present evidence in respect of the complaint; however neither the complainant or the respondent attended. I am satisfied that both parties were informed in writing of the date, time and place at which the hearing to investigate the complaint would be held.
Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
In the circumstances where the parties did not attend the hearing and, in the absence of any evidence to the contrary having been adduced before me, I must conclude that this complaint under the Redundancy Payments Act 1967 – 2012 is not well-founded and I decide accordingly |
