In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 39 of the Redundancy Payments Act 1967, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Decision:
As it is common case that the establishment closed and the business in which the Complainant was employed was wound up in November 2018 and the Complainant was made redundant by this the Complainant is entitled to a statutory redundancy lump sum payment based on the following:
Date of commencement of employment : 3rd May 2016
Date of termination of employment: 3rd November 2018.
Gross weekly pay : €817.
The payment is due on the basis that he has been in insurable employment for the requisite period of time.
