Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 6 of the Payment of Wages Act 1991,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant had over 16 years service with the Respondent when the shop closed suddenly and without notice in September 2018. The Complainant was not given her statutory entitlement to minimum notice. The Complainant’s weekly wage was €220.50 and she submitted that her entitlement was to 8 weeks notice or payment in lieu. The Respondent indicated to the WRC by written communication that they were not going to attend the hearing for stated reasons. |
Decision:
Based on the uncontested evidence of the Complainant that she had been employed by the Respondent from 1st June 2002 to 13th September 2018 and that she had received no payment for minimum notice, I have decided that her complaint is well founded. I require the Respondent to pay to the Complainant the sum of €1,764 within six weeks of the date of this decision.
