1. Voluntary Severance & Compensation/Disturbance
BACKGROUND:
2. This dispute relates to a claim by both NBRU and SIPTU for payment of compensation/disturbance monies and voluntary severance to 14 Bus Eireann drivers outbased in the Newbridge/Edenderry depots whose routes have been transferred to a new operator.
The Union says that the Company has failed to apply the current agreement around out based drivers.
This dispute could not be resolved at local level and was the subject of a Conciliation Conference under the auspices of the Workplace Relations Commission. As agreement was not reached, the dispute was referred to the Labour Court on the 15 May 2019 in accordance with Section 26(1) of the Industrial Relations Act, 1990.
A Labour Court Hearing took place on 15 August 2019.
RECOMMENDATION:
The Court has given very careful consideration to the written and oral submissions of the parties.
The Court sees merit in the proposition that the parties should re-engage directly in an effort to find agreement on the matters which were set out to the Court.
In the event that the parties fail to find agreement the matters may be referred back to the Court.
The Court so recommends.
