In accordance with Section 25 of the Equal Status Act, 2000,following the referral of the complaint / dispute to me by the Director General, I inquired into the complaint / dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint / dispute.
Background:
The issue in contention concerns alleged verbal abuse of the Complainant by the Respondent in the precincts of a two Circuit Court hearings on the 11th January 2018 and the 11TH April 2018. In addition, comments made by the Respondent in connection with a Midland Circuit Court on the 3rd December 2018 were also racially abuse and defamatory. |
1: Summary of Complainant’s Case:
The Complainant did not attend the Hearing . No evidence of any nature ,save the Complaint form, was offered. I am satisfied that the Complainant had been properly notified, in writing, of the hearing arrangements |

No evidence in support of the Complaint was proffered . The Respondent denied the complaint in its entirety. |
3: Findings and Conclusions:
As there was evidential basis, to the Complaint, supplied to the Hearing, I deem the Complaint to be Not Well Founded. |
4: Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
