Procedure:
In accordance with Section 13 of the Industrial Relations Acts 1969following the referral of the dispute to me by the Director General, I was available to inquire into the dispute and give the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.
Background:
The worker was employed by the employer from 7th August 2018 until 29th April 2019. The complaint was referred to the Workplace Relations Commission (WRC) on 22nd May 2019 and relates to a number of issues raised by the worker during the course of her employment. |
Summary of Worker’s Case:
The worker did not attend the adjudication hearing and was not represented. |
Summary of Employer’s Case:
The employer attended the adjudication hearing in order to put forward its position in relation to the dispute. |
Findings and Conclusions:
There was no attendance by or on behalf of the worker at the adjudication hearing. I delayed the commencement of the hearing to facilitate a late arrival. I also attempted to make contact with the worker and her named representative by telephone prior to the adjudication hearing taking place but was unable to do so. Neither the complainant nor the complainant’s representative have made contact with the WRC since the date of the adjudication hearing. |
Recommendation:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
In all of the circumstances of this dispute, and on the basis of the worker’s failure to attend the adjudication hearing, I do not recommend in the worker’s favour. |
