Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 13 of the Industrial Relations Acts 1969 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The Complainant claimed he was unfairly dismissed. He stated in the claim form he did not have 12 months service. |
Recommendation:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
The Respondent attended the Hearing. The Complainant was not present at the appointed date and time for the Hearing. For the record, the Complainant attended at the appointed venue and time, the day after the Hearing date and advised he had mistaken the date of the Hearing and apologised for his mistake. As the Complainant was not present at the appointed date and time of the Hearing I find that his claim is not well founded. He was advised of his right to appeal the Recommendation that would issue on his claim when he did attend at the named location on the subsequent day to the date of the Hearing. |
