Workplace Relations Commission Adjudication Officer:
Procedure:
In accordance withSection 79 of the Employment Equalityfollowing the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complainant is employed as a supervisor. She was informed by her employer that she will be obliged to retire at the age of 66 years due to funding for her role no longer being provided by the government department because of her age. |
Summary of Complainant’s Case:
The complainant acknowledged that the respondent listed on the complaint form is not her employer. It is the government department which provides funding for her role which is named as the respondent. |
Summary of Respondent’s Case:
The respondent did not attend the hearing |
Findings and Conclusions:
Given that the complainant confirmed that the named respondent on her complaint form was not her employer, I find that her complaint is not well founded. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
I find that the complaint is not well founded because the respondent listed on the complaint form is not the complainant’s employer. |
