Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 following the referral of the complaints to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

The Complainant did not attend the adjudication hearing to prosecute his case. |

The Respondent did attend the adjudication hearing and were ready to rebut the case raised against it. |
Findings and Conclusions:
On 29 September 2019, the Complainant made a complaint to the Workplace Relations Commission pursuant to the Payment of Wages Act, 1991. The complaint was scheduled for hearing on 14 November 2019.
At the time the adjudication hearing was scheduled to commence, it became apparent that there was no appearance by or on behalf of the Complainant. I verified that the Complainant was on notice of the adjudication and after waiting some time to accommodate a late arrival, I proceeded with the adjudication in the absence of the Complainant.
In these circumstances and in the absence of any evidence to the contrary having been adduced before me, I must conclude that the within complaint is not well-founded and I decide accordingly. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Based on the aforegoing, I find that the within complaint is not well-founded and must fail. |
