Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complainant has worked with the Government body since March 1999. He has not received any payslips since 13th September 2018, despite having requested on numerous occasions that they be sent to his work address. |
Summary of Complainant’s Case:
The complainant initially inquired as to why his payslips were not sent to his requested address on 26th September 2018 and on numerous occasions in July, August and September 2019. He was told on two occasions that there was a glitch with the system. He also contacted the body’s complaints department three times but nothing was done about the matter. He subsequently received scanned copies of payslips for the period from 13th September 2018 to 13th October 2019 but did not receive any payslip to his work address after this. |
Summary of Respondent’s Case:
The Respondent did not attend the hearing. |
Findings and Conclusions:
While I have sympathy for the complainant and cannot understand why the respondent has failed to send his payslips to the address that he requested, I note that there is no requirement under the Terms of Employment (Information) Act, 1994 to provide payslips. Accordingly, there is no breach of the legislation and the complaint is therefore not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complaint is not well founded. |
