1. Conditions Of Employment
BACKGROUND:
2. This dispute was the subject of a Conciliation Conference under the auspices of the Workplace Relations Commission. As agreement could not be reached, the dispute was referred to the Labour Court on 7 October 2019 in accordance with Section 26(1) of the Industrial Relations Act, 1990. A Labour Court hearing took place on 20 December 2019.
WORKER ARGUMENTS:
3. 1. The employees are seeking Public Service recognition for their positions as Directors of Education.
EMPLOYER'S ARGUMENTS:
4. 1. The employer maintains that they need the approval of the Department of Education & Skills to facilitate this claim.
RECOMMENDATION:
This dispute arises due to the inability of the Employer to meet the claim of the Workers. To do so the Employer requires the agreement of the funder. There is no dispute between the parties on the merits of the claim and, as a result, the Court recommends that the claim be conceded.
The Court recommends that the parties approach the funder jointly with a view to resolving the matter.
