Procedure:
In accordance with Section 41 of the Workplace Relations Act 2015, these complaints were assigned to me by the Director General. A hearing commenced on September 18th 2018. English is not the complainant’s first language and although he did not request an interpreter, it was apparent from the outset that he required assistance to understand the proceedings and give evidence of his complaints.
The hearing was adjourned and an interpreter was scheduled for a resumed hearing on January 25th 2019. The respondent’s managing director attended and was represented by counsel and solicitors. There was no appearance by or on behalf of the complainant. I am satisfied however, that the complainant’s representative, Mr Nowak, was notified in writing of the date, time and place at which the hearing was to be held.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
In the circumstances where the complainant did not attend the hearing, and in the absence of any evidence to the contrary having been submitted, I must conclude that these complaints are not well founded and I decide accordingly. |
