Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 6 of the Payment of Wages Act, 1991 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant worked, as a driver, for a haulage company for 8 days and says he was not paid his wages for that time. |
Summary of Complainant’s Case:
The Complainant did not appear. I am satisfied that he was given all notices required in relation to the hearing. |
Summary of Respondent’s Case:
The Respondent did appear and said that he would pay the Complainant for the days of work concerned. |
Findings and Conclusions:
As the Complainant did not appear and as such no case was presented to me I find that the Complainant fails. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 6 0f the Payment of Wages Act, 1991.
I find that the complaint fails due to the non-attendance of the Complainant and is not therefore well founded. |
