FULL RECOMMENDATION

1. (A) Pay matrix and (B) Annual Leave
BACKGROUND:
2. This dispute could not be resolved at local level and was the subject of a Conciliation Conference under the auspices of the Workplace Relations Commission. As agreement was not reached, the dispute was referred to the Labour Court on 25 January 2019 in accordance with Section 26(1) of the Industrial Relations Act, 1990. A Labour Court hearing took place on 15 February 2019.
UNION’S ARGUMENTS:
3. 1. The Union is disputing the employers proposal for a cost of living protection increase to be applied across all the salaries and salary ranges.
2. The Union is disputing the employers proposal for a " pot" to be spread over staff salaries based on their individual performance.
3. The Union is seeking that all staff receive a proportionate increase in annual leave.
EMPLOYER'S ARGUMENTS:
4. 1. The Employer is proposing 0.7% cost of living protection increase to be applied across salaries based on individual performance.
2. The Employer is proposing a pot equivalent to 2.3% of salaries to be spread over staff salaries based on their individual performance.
3. The Employer is proposing that all employees should receive a minimum of 23 days leave.
RECOMMENDATION:
The Court has given very careful consideration to the written and oral submissions of the parties.
The matters before the Court relate to the pay matrix and to annual leave.
Having considered the detailed submissions of the parties the Court recommends as follows:
- •That the company’s proposals, adjusted to incorporate understanding reached as regards Level 5 starting salary, Level 4 starting salary, Elimination of BKAZI Pay band and pension contributions should be accepted with the following modifications:
- For performance rating 4 the percentage increases should be applied as follows:
- • That all staff should be allocated one additional days leave for 2019 on a ‘once off’ basis.
The Court so recommends.
