Procedure:

In accordance with Section 13 of the Industrial Relations Acts 1969] following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute

Preliminary Issue

The respondent submitted that the complaint involves a body of workers and in accordance with the 13(2) of the Act the adjudicator has no jurisdiction to hear it.

The respondent provided evidence to the Adjudicator that the matter has been dealt with on a collective basis by way of a national agreement, which comprehends the claimant.

Decision:

Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.

I find that I have no jurisdiction to hear it.
