Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaints to me by the Director General, I inquired into the complains and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complains.
Background:
The Complainant in his written submission to the WRC alleged various breaches of his rights including breaches under the Terms of Employment (Information) Act, the Organisation of Working Time Act, and the Payment of Wages Act.
Summary of Complainant’s Case:
The Complainant failed to attend the hearing. The Complainant’s Representative attended and advised the Complainant was not available to attend.
Summary of Respondent’s Case:
The Respondent failed to attend the hearing.
Findings and Conclusions:
I am satisfied the parties were properly notified of the hearing date and location.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints.
As the Complainant failed to attend the hearing I find the complaints fall due to lack of prosecution, and decide the complaints are not upheld.
