Procedure:
In accordance with Section 8 of the Unfair Dismissals Acts, 1977 – 2015 and Section 13 of the Industrial Relations Acts 1969 andfollowing the referral of the complaint and dispute to me by the Director General, a Hearing was scheduled for 29th August 2018. The Complainant did not attend the scheduled Hearing.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint CA-00019261-001.
This complaint under the Unfair Dismissals Act, 1977 was lodged with the Workplace Relations Commission on 7th May 2018. A Hearing was scheduled for 29th August 2018. I am satisfied both Parties were notified in writing of the Date, time and place at which the Hearing to investigate this complaint would be held. The Respondent attended the scheduled Hearing. There was no appearance by or on behalf of the Complainant. In these circumstances and in the absence of any evidence to the contrary, I must decide that this complaint is not well founded.
In accordance with Section 41(5) of the Workplace Relations Act, 2015 I declare this complaint is not well founded.
RECOMMENDATION – CA-00019261 -002
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute. – In accordance with Section 13 of the Industrial Relations Act, 1969. This complaint was submitted to the Workplace Relations Commission on 7th May 2018.
A Hearing was scheduled for 29th August 2018. I am satisfied both Parties were notified in writing of the Date, time and place at which the Hearing to investigate this dispute would be held. The Respondent attended the scheduled Hearing. There was no appearance by or on behalf of the Complainant. In these circumstances and in the absence of any evidence to the contrary, I must decide that this complaint is not well founded.
