Industrial Relations Act
Background
The claimant was employed by the respondent from the 23rd April 2018 until the 14th June 2018. He stated that he was paid €500 gross working a 45-hour week. The claimant submitted that prior to commencing employment he had permission to take holidays which he had already arranged. The claimant further submitted that he had been on to the Revenue commissioners about the emergency tax that was being deducted from his wages. He stated that everything was in order on their (revenue)side and that it was a matter for the respondent to get their side sorted out. It was alleged that a meeting took place with the respondent’s accountant. The claimant stated that he felt under pressure and stress and he was unable to attend work on that day.
The claimant stated that he went on holiday as arranged and his work colleague was informed that they were both dismissed. The claimant never received any documentation/correspondence from the respondent to tell him why he was dismissed.
Findings
The respondent did not attend.
The complaint was received on the 3rd July 2018.
I find that based on the uncontested evidence that was provided at the hearing fair procedures were not applied.
Recommendation
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.]
I award the claimant €500 in compensation.
