Procedure:
In accordance with Section 39 of the Redundancy Payments Acts 1967 - 2014 following the referral of the complaint(s) to me by the Director General, I inquired into the complains and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints
Background
The claimant was employed by the respondent from 8th November 1999 until the 9th May 2018 as a driver. He was paid €371.22 per week. It was submitted that the respondent gave notification of redundancy on the 17th April 2018 for the employment to terminate on the 9th May 2018.
The claimant has not received any redundancy payment from the respondent. It was submitted that having contact the Department of Social Protection who confirmed that the claimant was entitled to 38.04 weeks redundancy amounting to €14277.02 entitlement.
Findings
The respondent did not attend
Decision:
[Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
I find that based on the documentation presented at the hearing, the complaint is well founded and the claimant is entitled to 38.04 weeks redundancy amounting to €14277.02
