Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and or Section 6 of the Payment of Wages Act, 1991 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

The issues in contention concern a claim for alleged Unpaid Wages and Holiday Pay due to the Complainant. |
1: Summary of Complainant’s Case:
The Complainant worked for the Respondent from 16/04/2018 to the 17th /09/2018. On cessation she was due € 2,115.66 Gross Pay. She has received no salary or wages for this period. Holiday Pay was also outstanding. The sum outstanding is therefore €2,115.66 Gross Pay plus €625 Holiday pay = €2,740.66 |
2: Summary of Respondent’s Case:
The Respondent did not attend the Hearing. No evidence was presented. |
3: Findings and Conclusions:
I was satisfied that the Respondent had been put properly on notice of the Hearing. The Complainant provided written evidence of her employment including numerous copy text messages, a P45 and Pay Slips that had been issued but not honoured. I took her evidence to be credible. Accordingly, under the powers conferred on me by the Terms of the Payment of Wages Act,1991, I award the sum of € 2,740.66 to the Complainant. The taxation of the award to be considered in conjunction with the Revenue Commissioners. |
4: Decision:
Section 41 of the Workplace Relations Act 2015 and Section 6 of the Payment of Wages Act, 1991 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions of the cited Acts.
