Procedure:
This complaint was submitted to the Workplace Relations on October 23rd 2018. The complainant alleges that she has a grievance with her former employer that falls to be adjudicated upon in accordance with section 13 of the Industrial Relations Act 1969. On November 26th, the parties were notified of the date of the hearing. On November 30th, the complainant’s representative applied for an adjournment as the complainant is in Spain and has not booked a return flight. The request for an adjournment was refused and this was communicated to the complainant’s representative on December 13th.
The respondent’s Industrial Relations Manager and Solicitor attended the hearing on December 19th but there was no appearance by or on behalf of the complainant. I am satisfied that she and her representative were informed in writing of the date, time and place at which the hearing to investigate her complaint would be held.
Decision:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
In the circumstances where the complainant did not attend the hearing, and in the absence of any evidence to the contrary having been adduced before me, I must conclude that the within complaint is not well-founded and I decide accordingly. |
