Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant was employed by the Respondent from 26/09/2018 until 18/10/2018 as a cashier at their retail outlet. The Complaint referred under section 6 of the Payment of Wages Act, 1991 was received by the Workplace Relations Commission on 26th October 2018. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing and sent no notification to the WRC regarding her non-attendance. Information in relation to the date, time and venue of the hearing had been sent to the address provided by the Complainant on 26th November 2018. The complaint form completed by the Complainant does not contain a telephone number or email address. |
Summary of Respondent’s Case:
The Respondent did not attend the hearing. |
Findings and Conclusions:
I am satisfied that the complainant was on notice of the hearing, that the non-attendance has not been explained and I therefore find the complaint is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
