Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
The complainant worked with the respondent for only two days in January 2018. He was not paid his wages for either of these days. In his submission to the hearing the complainant stated that he had contracted to work with the respondent for €15 per hour and stated that he would not work in excess of nine hours per day. On the first day, January 29th he worked a total of fifteen and a half hours. On the second he worked ten hours. He did not receive payment for either day despite promises of payment from the respondent. He says he is owed €382.50 on the basis of the hours worked at €15.00 per hour. |
Summary of Respondent’s Case:
The respondent did not attend the hearing. Although there was a minor error in the respondent address it was not such as would prevent delivery. I find therefore that the respondent failed to attend without satisfactory explanation. |
Findings and Conclusions:
The complainant was a credible and honest witness and I accept his evidence as being true. His complaint succeeds. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
I uphold complaint CA-00017761 and award the complainant €382.50 gross wages and subject to the usual statutory deductions. |
