This dispute was submitted to the WRC on March 22nd 2019 and, in accordance with Section 13 of the Industrial Relations Act 1969, it was assignedto me by the Director General. A hearing was arranged for July 15th 2019 for the parties to have an opportunity to be heard and to present evidence relevant to the dispute.
Background:
In 2013, this dispute was referred for a hearing at the former Labour Relations Commission under section 13 of the Industrial Relations Act 1969. The parties attended a hearing by a Rights Commissioner and a recommendation was issued. The complainant’s position is that the recommendation has not been implemented by the respondent and this is the subject of the current dispute. At the opening of the hearing, Mr Glynn said that it was the union’s view that the issue should not be adjudicated on today, as it has already been investigated and decided upon by a Rights Commissioner. For this reason, Mr Glynn submitted that I have no jurisdiction to open the matter again for adjudication. It is the union’s intention to seek to have the recommendation of the Rights Commissioner implemented by some other means. |
Decision:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
As the union has decided not to submit this dispute for adjudication, I make no recommendation on the matter. |
